MESSAGE FROM AFGE PRESIDENT

Dear Member,

Like you, we've heard the reports of the White House considering withholding the backpay of federal employees furloughed during this government shutdown. This is clearly another attempt by this administration to bully and intimidate the federal workforce.

The frivolous argument that federal employees are not guaranteed backpay under the Government Employee Fair Treatment Act is an obvious misinterpretation of the law. It is also inconsistent with the Trump administration's own guidance from mere days ago, which clearly and correctly states that furloughed employees will receive retroactive pay for the time they were out of work as quickly as possible once the shutdown is over.

As we've said before, the livelihoods of dedicated federal workers serving their country in the federal government are not bargaining chips in a political game. It's long past time for these attacks on federal employees to stop and for Congress to come together and end this shutdown.

And make no mistake, we will challenge any effort to withhold the backpay of federal employees furloughed during this shutdown.

AFGE/SSA ShutDown MOU

The federal government shuts down when Congress fails to pass funding bills that allocate money to agencies so they can function. The current budget expired at 11:59pm September 30, 2025. If a budget is not approved SSA will not have funds approved for payroll, and has historically required the essential employees to continue working. If the government goes into a shutdown your pay scheduled for October 10, 2025 will only cover hours worked from September 21-30. All subsequent pay will be delayed until a budget is approved.  

The Attached Memorandum of Understanding (MOU) between AFGE and SSA was updated in October 2023 to add the following language: #13 Management will consider excepted employees furlough request similarly to leave requests made under Article 31 of the National Agreement. Preapproved leave will normally be honored with a lapse occurs. Employees on preapproved leave may request to substitute furlough time for their leave.

SSA violated the contractual agreement in March 2025 when they suspended/cancelled Telework. AFGE filed a grievance March 25, 2025 (see attached). The grievance was not resolved and AFGE has moved the case to a 3rd party Arbitrator for resolution.

The Arbitration hearing is scheduled for September 16-17, 2025.

AFGE received the attached notice with a proposed rollout of service observations to employees. The impact of live screen captures of every screen opened during the call will lead to an increase in disciplinary actions if you read your email, chat with a coworker, etc.

See attached notice. AFGE will demand to Bargain the impact and implementation.
